In Colorado, the right to bring a wrongful death claim depends on both who survived the deceased and how much time has passed since the death. During the first year after a person’s death, the surviving spouse has the exclusive right to file a wrongful death claim. The spouse may choose to allow the deceased’s heirs, such as children, to join in the lawsuit, or may permit them to file the claim themselves. If there is no surviving spouse, the claim may be brought by the heirs or by a designated beneficiary. In situations where the deceased left no spouse, heirs, or designated beneficiary, the law allows the siblings of the deceased—or the heirs of those siblings—to bring the claim.
In the second year following the death, the law expands the group of people who may file. At that point, the spouse, the heirs, or both together may bring the claim. A designated beneficiary may also bring the claim along with the heirs. If the deceased had no spouse, heirs, or designated beneficiary—and was unmarried, without descendants, and without surviving parents—then the siblings of the deceased, or their heirs, may bring the action.

Only one wrongful death action can be brought for the same death, regardless of the number of eligible claimants. If multiple eligible claimants exist, they may need to coordinate and potentially join together in a single action or agree on the distribution of any damages awarded.
